Administering and Operating Minor Economic Agencies

  1. Executive committees as well as the Management and Planning Organization in province should detect the advantages and benefit of different economic parts of the provinces based on the documents of provincial development and preparing public lands projects through the Fourth Economical-Social-cultural Development Plan and announce the policies of each province in the beginning of each year based on beneficial activities and projects. The Labor Committee in ach province is also responsible to detect non-economical saturated markets and occupations. Banks and financial institutions shall not accept such projects.

  2. Executive committees in ach province are also responsible to, before any referring to the Labor committee, consider the economical and technical explanations and justifications of the projects and also the abilities and skill of the project executives. The executive committees may send the proposal to the secretariat of the Labor Committee after the considerations are done.

  3. All the applicants should specify the number and features of the needed workforce and attach the economical and technical explanation report. Executive committees are responsible to enter the given information in the software of minor economic agencies.

  4. There must be a committee entitled as Training and Providing Human Resources which will be administered by the Deputy of planning in Municipality and has several other members: the Labor and Social Security Organization in the province, Department of Technical and Professional Training, Department of Education and state and private universities. The committee should adopt action towards providing the needed human resources using the information in Article 3.

  5. Committee of Labor and Investment in the province should adjust the project with the policies of the province and introduce a bank to the applicant.

  6. Introduced banks are responsible to consider the project within 10 days and to announce lack of any necessary document. According to the Article 6of the executive bylaw, banks should announce the results to the applicant and the secretariat of the committee within 45 days.

  7.   Banks are responsible to deliver the confirmed projects to the committee and to receive a confirmation from the committee as well as granting the needed credits and amenities.

  8. Banks are responsible for taking a written commitment from the applicant and to make sure that credits are spent to provide new jobs. They are also responsible to make sure the project is done in the right time and with a good quality. If the applicant ignores the commitment, the bank shall take legal action towards regaining the credits and facilities as well as the specified interest.

  9. Banks shall observe the way credit are spent and grant the following credits

  10. All the applicants of credits more than 200 million Rials should pass the entrepreneurship courses in a certified entrepreneurship institute

Note 1 – Subsides to the productive projects also require to pass the mentioned courses

Note 2 – the expenses and tuition fee of the courses are by the applicant

  1. Applicant should inform the banks and the executive committees after the project are productive enough.

  2. Banks and the Labor and Investment Committee of the province may leave the project’s consideration to the qualified and certified consultative companies based on the instructions

  3. The authorized committees are responsible to consider the entrepreneurship and investment promised in the project, o observe the projects and take necessary actions to stable them.

  4. Granting investment credits to agencies with less than 10 insured employees is forbidden

  5. Based on the Cabinet’s ratification No. 34922/29838 2005, The Committee of Labor and Investment in each province is allowed to dedicate 20% of the provincial credits to stabilize the occupations and provide currency and cash for minor economic agencies

  6. 50% of each province’s ratified credit will be dedicated to create, develop and complete the middle and large economic agencies (more than 50 workers)   

  7. Duration of the projects will be decided by the Committee of Labor and Investment in each province

  8. The number of self-employments shall not exceed 10% of the predicted employment in the province. The share for the predicted self-employment will be also accorded with the same frame.

Note – Self-employment projects of Foundation of Martyrs and Department of Veterans are prioritized

  1. Credits and facilities for construction and building projects have been separated from credits of minor economic agencies in the current year. Therefore, applicants of construction facilities may refer to the Council of Housing and Urbanization, although the committee of Labor and Investment is yet responsible to observe the employment in this field monthly and represent the reports to the High Council of Employment in the Ministry of Labor and Social Security.

  2. Exporting information will be automatic and by computers, therefore all the executive committees and the banks should present a detailed report of their performance to the Committee of Labor and Investment and all the information must be carefully recorded in the database of minor economic agencies. Consequences of resenting any false data will be redirected to the presenter.

  3. Considering the productivity of projects, the supervising committees in each province are responsible to provide their fortnightly reports to the Municipality and the Municipality will report monthly to the Ministry of Labor and Social Security.

  4. Governors are responsible to use the national credits and assets for the rest of needed credits in the province based on the executive regulations of budget in 2007. This direction is in 22 articles and 3 notes and should be applied since the date of notification. All the regulations contrary to the direction are nullified.
